Let’s look at just what “Public Domain” is.

Wikipedia defines “Public Domain” as follows:

“The public domain comprises the body of knowledge and innovation (especially creative works such as writing, art, music, and inventions) in relation to which no person or other legal entity can establish or maintain proprietary interests. This body of information and creativity is considered to be part of the common cultural and intellectual heritage of humanity, which in general anyone may use or exploit.

However, when copyright or patent restrictions expire, works will enter the public domain and may be used by anyone for any purpose.”


Public Domain is the vast body of material that includes books, photos, music and information that is available for the public to use and republish…free.



What that means for you and me is that when the copyright or patent expires on a creative work (book, work of art, etc.), anyone may freely use that work LEGALLY in any manner they choose without the obligation of paying royalties to the creator of the work.

There are over 85 million books on every conceivable topic know to the human imagination…and that does not include art, movies, photographs, and just about every other type of media imaginable


.All of this is normally protected by copyright laws, but copyright protection is not forever. Intellectual property that is not covered by copyright laws belongs to the public domain.


Therefore, it is open to everyone who wants to use it.

The public domain contains timeless classics, collector paintings, artwork, and even plays, poetry, scripts, as well as works of fictions, true crime novels, mystery and suspense stories and countless other valuable creations that are still not only relevant in today’s society, but in demand.

A work is considered in the public domain if:

1. It was published in the United States prior to 1923.

2. It was published in the United Stated between 1923 and 1978 without a valid copyright notice.

3. It was published in the United States between 1978 and March 1, 1989, without a notice and registration.

4. It was published in the United States between 1923 and 1963 with a copyright notice that was not renewed (remember, only 7% of copyrights issued through 1958 were renewed!)

5. It was published by the United States Government or its Agency from 1779 to 2013
